I got fired last year after my employer got caught under paying people me included and I sued him and got the wages owing

However he won’t give me a payment summary for the past financial year. I’ve emailed and asked for it and he said that the accountant is still doing it. Or he forgot to email it and so on

Is there a time limit for the payment summaries to come out? And if he won’t give me one is there any way to get one so I can still do my tax return?

I would contact ATO and explain the situation and ask what they would recommend to do next.

Similar thing happened to my husband years ago, they finally sent it out in September after pretty much begging them (We were young at the time and desperately needed the cash).
I have no advice but I don't believe there's a timeframe in which they must be done.

My ex had to go to fair work Australia to get it.

Supposed to be provided to employees by 14 July each year. Call ATO and advise ex employer not providing payment summary. Have their legal name (i.e. Company/trust name not just trading name, abn, contact name and number for employer).

He was meant to give it to you by 14th July, however if they advise you they haven’t done it yet then they can take longer. however he shouldn’t even be emailing it as they must ensure you have a means to a printer so should send a printed copy.

Emailing is the correct way to go about this as you have written evidence from him. If it goes on too long, you can actually do a payment estimate yourself as per the ATO rules. I believe you may need a stat dec which is easily obtained.

If all payments have been taxed and reported to the ATO your income should already pre-fill into your tax return. Get your return sorted then find out what's what. I believe he's outside of the time limit so report him to Fair Work or the ATO.

Yes, if it has been done, you don’t need the payment summary from them if your accountant has the portal, they should be able to access it right? Also, if you do through myGov yourself, it should be prefilled shouldn’t it? That my experience anyway.

I did a stat dec once when I didn't get a group certificate. Stated why I believed I hadn't received the group certificate and how much I earnt each week for what period etc.
