Hi, I'm posting for a colleague and hoping someone here has some advice. How do you go about kicking someone out of a house. His ex is living in his house rent free and won't leave. The house is in his name but he is aware he will have to pay her out anyway and is okay with that but she wont leave. How can he get to her from a legal stand point.
ETA- never married just partnered.

If married get a divorce.
He can just put the house on the market, nothing stopping him from doing that 😂. Sounds like he will have to have a chat to a lawyer and see what he can do.
I think there needs to be more information. Are they both currently living there, are there children involved. You mention that he knows he is going to have to pay her out and is ok with that. Maybe that would be the best starting point offer a payout figure perhaps his ex doesn't have the financial means to leave. They should both be seeking legal advice and take it from there. Unfortunately even though the house is in his name if the ex has an entitlement to be paid out they could place a caveat on the house due to financial interest which would hinder a sale.
