Making up a sick day at work

Making up a sick day at work

I am a full time employee.
I have 65 sick days saved and over 600 hours annual leave.
I have every Thursday off work paid as annual leave until the end of the year to break down this amount.

My daugher was unwell. I was given a carers certificate to stay home with her on Tuesday.

I went to work today as normal.

My manager asked me if I could work this Thursday to make up for having the Tuesday off.

Is that legal?

I pointed out I had the carers certificate for the Tuesday and she said oh cool, can you work the Thursday anyway,

I did get paid the Tuesday as a sick day.

Why do I have to make this sick day up?
Im not sure what was implied... what am I making up for?
And if I work the Thursday I would be paid as normal.

No you don't have to make it up. That's a sick day. If you have plans say you can't. If you can, and they have work to catch up on, you would be paid for it instead of annual leave. But your agreement is that it's booked annual leave so you have every right to say no you can't do it.

Def don’t have to make it up! I’d just say no sorry I already had plans as it is an annual leave day.

Nope. You have a cert. Done and dusted.

No, you absolutely don’t have to! However she may have asked you in a “catch up with the work” way you missed and just make sure you’ll be paid for the Thursday as normal. However you’re entitled to say no too. I personally work the make up days so I don’t fall behind :) workplaces need to be equipped for worker’s taking their leave entitlements and have a back up for those days it happens.

I guess it depends on the job you have and if you're the only one that can do it in the workplace. They may have also swapped someone else, your shift for their Thursday shift so have no one else for that day. If you can't work it just say no, it's their own problem really.

You I don’t have to make it up, thu probably pulled someone from the Thursday shift and don’t want to have to pay them overtime for doing the Tuesday shift. Especially if they aren’t getting 2 consecutive days off in a row which is a legal requirement in most businesses practices (except fifo).

Inform them that you have Thursdays off to cut down the amount of annual leave you have stored (you have a lot of annual) that by paying you for sick leave on Tuesday and then getting you to work Thursday too that it will override the annual and leave loading you will receive and you’ll have to fill in the paperwork again which you aren’t willing to do. If you have plans lead with that. It’s their responsibility to cover you when you’re sick and I’m telling you now they don’t give a rats about you personally and are just trying to make their lives easier. They would not do the same in return.
