Hello,

I'm just wondering if anyone has any experience with TAC? (Victorian government run CTP insurance)

2.5 years ago I was on my way to work and was hit by a car as I was crossing the road, I had almost crossed the whole road and had a green man.

I fractured my spine and left fibula (leg) and have daily pain my my left hip along with the pain from the fractured bones.

The person that hit me was charged.

I have been battling it out with TAC with my lawyers for a serious injury certificate which you aren't eligible to apply for until 1 year after the accident and after you've seen medico legal doctors who wrote their reports based on their consultation with you and your medical records, this certificate basically gives me the right to apply for compensation for your injuries and you are only eligible for compensation if TAC thinks you have enough for a serious injury.

Well fast forward to last week and I've been told that TAC does not think I have a serious injury to proceed to the next step to discuss compensation. TAC has contacted my old work, a big public hospital and spoken to HR and gotten hold of my records, they have mentioned I was a 'standard' employee, and that I had considerable amount of time off for 'tonsillitis' however at the time of the injury I had a weeks worth of sick leave accrued so if I was taking unnecessary sick leave I wouldn't have any accrued. I must also mention that my daughter had her tonsils out so I may have had time off for her but I cannot remember.

At the time I was studying which was paid by my employer in a course which I had to give up as I wasn't able to get into the city, or sit the practical exams. TAC who was unable to gain access to information from RMIT (not even my lawyer could only i can) is saying that I wasn't enrolled at the time.

I was also privately investigated and photos taken of me and my children one of which I was at a cafe and apparently look too happy and how I appear isn't consistent with my mental health report, which is bullshit! How I appear in public and with my children isn't representative to how I am behind closed doors when my children are asleep, I'm in pain but I'm a mum and I put on a happy face for my children and I don't let my injuries get the best of me, a mum doesn't curl up in bed when she's unwell, she gets on with it.

They are basically saying I am not a creditable person and what I am saying about my injuries and mental health and actually said that I am not a credible person!!

The next step is to go to court and hire a barrister, this is costly and could be tough on my mental health having to deal with what TAC might say about me.

Has anyone else been treated like this? What did you do? What was your outcome?

I am so shocked, I never thought I would be treated like this prior to going into this, I thought TAC was there to help people in need, obviously there are those who take advantage of the system, but for me it should be open and shut, I have police reports, X-ray report (which I cannot fake) and it's so obvious that I have injuries and I was not at fault so I am shocked at TAC treating me like a criminal.

Not exactly the same situation however I know of someone who is claiming workers compensation for a supposed injury at work. It's all a lie and they're being investigated. All I know is that for them to investigate you they must seriously think you are not as injured as you are. It's completely standard for them to contact previous employment and find out what type of worker you were and come to a conclusion about the amount of time off you had. It's so that they can check previous history of illness and whether or not you were "lazy" by the books. You can certainly fight it in court and have the conclusions overturned but they're basing everything off of what they're being told by employment/RMIT. Without access to RMIT records it's correct that they're assuming you weren't enrolled, in court you can supply the documentation to show you were. It's a really, really long road but worth fighting.

As for the mental health - have you been seeing a psychologist or at least been to a GP about a mental health plan? As you could have a report written by both GP and psychologist to state your mental health. If not - it's all your word against their's unfortunately.

I also should add the I work in administration/HR and when we receive calls or requests for information, they ask basic facts such as how many sick days, how was your work performance - they don't gain heaps of information so that is why you would need to argue/prove in court reasoning behind.
