Changing children's last name without consent

Is it possible to change your child's last name without the consent of the father?
I want to re-marry, but the kids want to share the same last name as their sister and myself. I have no court documents or neither had contact with him in over 5 years. Located in Queensland if that helps. Please if anyone has any successful stories or information would be greatly appreciated.

You might have better luck getting his parental rights completely terminated.

You'd have to go to court to seek permission to do it. So best speak to a lawyer

you have to be able to prove you cant find the biological parent if the form isn't signed. No contact doesn't unfortunately constitute a reason. I know it seems really important you all have the same surname but just try to re-enforce you are all family no matter what your surname is and family means supporting and loving and backing each other through thick and thin. It is afterall just a name. In our house my kids from my first marriage have their dad's surname, i have my maiden name and my husband has his surname so 3 different surnames in the one house. We just treat it like a joke. The dog has all our surnames on his register with the counsel and vet lol

In QLD you can apply to the Magistrates Court for change of name orders and change of name orders only! Nothing else. Don't go through Family Court as it will open a can of worms. Go see a Lawyer and ask them to put the application through the Magistrates Court. I work in law. We do it regularly.
